PRIVACY POLICY

Mitrajaya Holdings Bhd and its related companies ("we" or "us"), as the Data Controller under the Personal Data Protection Act 2010 (as amended by the Personal Data Protection (Amendment) Act 2024) ("the Act") respect and are committed to the protection of your personal information and your privacy. This Personal Data Protection Notice ("Notice"), prepared in accordance with the Act, sets out our Personal Data protection practices that are put in place to safeguard the Personal Data of individuals who we deal with. For the avoidance of doubt, the relevant Mitrajaya Group entity which collects your Personal Data in connection with a particular product, service or transaction shall act as the Data Controller for such processing.

Please note that we may amend this Notice from time to time. Any amendments will be made available on our website and shall take effect from the date of publication.


Collection of personal data

The Personal Data collected by us may include (but is not limited to) the following:

(a) Personal Data

Information such as your name, date of birth, identification supporting documents (including NRIC or passport number), gender, nationality, current private and/or business address, telephone and/or mobile phone number(s), email address(es), occupation details, financial and transaction-related details, CCTV recordings, and any other information deemed necessary.

Your Personal Data may be collected either directly from you or indirectly from your authorised representatives including when you or your representatives submit an enquiry form, sales data form, registration form and/or other questionnaire through hardcopy paper form, online registration, telephone conversation or any other means.

We may also collect certain information automatically when you visit our websites, including through cookies and IP address information.

(b) Sensitive Personal Data

Sensitive Personal Data such as physical or mental health or condition, political opinions, religious beliefs or other beliefs of a similar nature, commission or alleged commission of any offence, and biometric data (such as fingerprints and facial recognition), for which explicit consent will be obtained before collecting or processing such Sensitive Personal Data, except where exemptions under the Act apply.

Purposes of Collecting and Processing Personal Data

Your personal data is collected and processed for purposes including but not limited to:

  • To facilitate property transactions related to sales, purchases and relevant services.
  • For customer relationship management, including responding to inquiries and processing payments and/or transactions.
  • Managing inquiries, complaints, and customer support.
  • Facilitating internal record-keeping and administrative processes.
  • Communicating with you regarding our services, promotions, or updates.
  • For quit rent and/or assessment rate payment purposes (where applicable).
  • To comply with legal and regulatory obligations, including under the Ministry of Housing and Local Government, Inland Revenue Board and other relevant authorities.
  • To supply Personal Data to authorities, utility providers and/or service providers as required under the law or where necessary for the above purposes.
  • Marketing communications: Where you have provided your contact details, we may contact you for promotions, events, launches and updates. You may opt out from receiving marketing communications by notifying us.
Disclosure of your personal data

Personal Data provided to us will generally be kept confidential but you hereby consent and authorise us to provide or disclose your Personal Data to our affiliated companies and/or organisations that act as our agents, contractors, service providers, auditors, consultants, accountants, lawyers or other financial or professional advisers, any parties to whom we are under a legal requirement to disclose the Personal Data to by applicable law or in response to an authoritative body, including government agencies, statutory authorities, local councils and/or industry regulators including but not limited to the land office, the land registry, the Ministry of Urban Wellbeing, Housing and Local Government, the Employees Provident Fund Board, the Inland Revenue Board, as well as to any other third party pursuant to any court order.

Data Integrity and Security

We will take all reasonable steps to make sure that the Personal Data collected, used or disclosed is accurate, complete, not misleading and up-to-date.

We will retain your Personal Data only as long as necessary for the purposes described above or to meet legal requirements. Any Data no longer required will be securely destroyed or anonymised.

Data transfer and sharing

Where we consider it necessary and/or appropriate, we may transfer your Personal Data to another affiliate or third parties within or outside Malaysia, under conditions of confidentiality and similar levels of security safeguards to protect your Personal Data.

Rights of Data Subjects

You have the right to:

  • Check whether we hold or use the Personal Data and request access to the same;
  • Request that we correct any of the Personal Data that is inaccurate, incomplete or out-of-date;
  • Communicate to us your objection to the use of the Personal Data for marketing purposes;
  • Withdraw, in full or in part, your consent, subject to any applicable legal restrictions, contractual conditions and reasonable time period;
  • Request the transfer of your Personal Data to another Data controller (subject to applicable regulations);
  • Request the erasure of your Personal Data where no longer necessary or where consent is withdrawn; and
  • Request that we restrict processing of your Personal Data under specific circumstances.

In the event of a data breach involving your Personal Data, we will notify you and the Personal Data Protection Commissioner (PDPC) where required by law.
